Cancelled Visas: In certain situations, a visa may be cancelled at the discretion of the Department of Home Affairs. While visa holders or sponsors can make a request for cancellation, only the Department holds the authority to approve and action a cancellation.

It’s important to note that if a visa is cancelled, this may also affect the visas of any accompanying family members.

Employers, sponsors, or family members cannot directly cancel a visa. However, in cases involving individuals under 18 years of age, an employer or a person with parental responsibility may request cancellation on their behalf.

  • There is non-compliance with visa conditions

  • The visa holder does not meet character requirements

  • False or misleading information was provided in the visa application

Monitoring

The Department of Home Affairs imposes conditions on visa holders, including limits on their stay and the nature of their permitted activities. At the same time, sponsoring businesses must comply with their sponsorship obligations.

To ensure compliance, the Department actively monitors both sponsors and visa holders. This may include requests for information in line with sponsorship obligations, unannounced or scheduled site visits to business premises, and collaboration with other government bodies such as the Fair Work Ombudsman, the Department of Employment and Workplace Relations, and the Australian Taxation Office.

Monitoring may be carried out by Immigration Inspectors, Fair Work Inspectors, or Fair Work Building Industry Inspectors. Failing to cooperate with these officials constitutes a breach of sponsorship obligations.
